Terms of Use

Welcome to Snitchy. These Terms of Use ("Terms") govern your use of the Snitchy Camera app, the Snitchy dashboard app, the websites snitchy.net and snitch.cam, the related cloud service, and the Snitchy hardware store (together, the "Service"). The Service is operated from Australia by Snitchy ("we", "our", or "us").

By creating an account, installing the apps, or buying from the store, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. What Snitchy is

Snitchy lets you repurpose a spare Android phone as a long-term time lapse and monitoring camera (the Camera app) and watch it from your main phone (the dashboard app). The Service includes scheduled image capture, on-demand capture, cloud storage, time lapse video rendering, optional public share links, and notifications about your camera's health.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you confirm that a parent or guardian has agreed to these Terms on your behalf.

3. Your account

• You can sign up with an email and password, or with Google or Apple sign-in.
• You are responsible for keeping your credentials confidential and for all activity under your account.
• Tell us straight away at jordan@snitchy.net if you think someone else has access to your account.
• Each camera phone is paired to one account. Unpairing a camera or deleting your account invalidates that camera's access.

4. Acceptable use

You agree to use the Service only for lawful purposes and in line with the laws that apply where you and your camera are. In particular you agree that you will not:

• Use the Service for unlawful surveillance, stalking, harassment, or anything that violates another person's privacy
• Film places where people have a reasonable expectation of privacy, or film employees or contractors without the notices required by workplace surveillance laws
• Place a camera anywhere you do not have permission to place it
• Capture, store, or distribute unlawful content
• Reverse engineer, decompile, or tamper with the apps or the backend
• Interfere with, overload, probe, or disrupt the Service or other users
• Resell or sublicense the Service without our written permission

You are solely responsible for what your camera films and for obtaining any consents required by law. We may suspend or terminate accounts that breach this section.

5. Plans

Snitchy has a Free plan and a paid Pro plan. Current limits are shown in the app and may change over time. At the effective date:

• Free: 1 camera, 1 GB of cloud storage, images kept for 30 days, scheduled and on-demand capture, and a limited number of time lapse renders at up to 720p with a Snitchy watermark.
• Pro: up to 5 cameras, 25 GB of cloud storage, images kept for as long as your subscription is active, unlimited time lapse renders at up to 1080p without a watermark, Pro editing tools (title and end cards, logo, music, day and time filters, stabilisation), and public share links.

Pro is sold at the price shown in the app at the time of purchase, in your local currency where the stores support it.

6. Subscriptions and billing

• Pro is an auto-renewing subscription purchased through the Apple App Store or Google Play. Billing, renewal, cancellation, and refunds for subscriptions are handled by the store under its own terms. We cannot issue subscription refunds ourselves.
• Your subscription renews automatically until you cancel it in the store's subscription settings. Cancel at least 24 hours before the end of the current period to avoid being charged for the next one.
• Deleting your Snitchy account does not cancel your subscription. Cancel it in the store first.
• If we change Pro pricing, the change applies from your next renewal and the store will notify you as its rules require.
• Promo codes and complimentary Pro access we grant are personal to your account, cannot be transferred or exchanged for cash, and may have an expiry date.

7. Storage limits and downgrades

• When you reach your plan's storage limit, new captures may be rejected until you delete images or upgrade.
• If your Pro subscription ends and your storage exceeds the Free limit, your account enters a 30-day read-only grace period. Your images remain visible, but new uploads pause. After the grace period the oldest images are removed until your storage fits within the Free limit.
• Free plan images are automatically deleted 30 days after capture.
• We may delete data from accounts that have been inactive for more than 12 months, after emailing the address on the account.

8. Your content

You own the images and videos captured through the Service. You grant us a limited, non-exclusive licence to store, copy, resize, transcode, render, and transmit your content solely to operate the Service for you (for example, to create thumbnails, render time lapse videos, deliver push notification previews, and serve share links you have turned on). This licence ends when you delete the content or your account, subject to the retention periods in our Privacy Policy.

Time lapse music is licensed for use inside videos you render with Snitchy. Do not extract it for other uses.

9. Share links

If you turn on a share link, anyone with the link can see that camera's latest image, its name, and the capture time without an account. You are responsible for who you give the link to and for the content it shows. You can turn a link off at any time and it stops working immediately. We may disable a share link that is being used in breach of these Terms.

10. Intellectual property

The Service, including the apps, website, mascot, branding, and software, is owned by Snitchy and protected by copyright, trade mark, and other laws. We grant you a personal, non-transferable, revocable licence to use the apps for their intended purpose. Nothing in these Terms transfers any of our intellectual property to you.

11. Service availability

We work hard to keep Snitchy reliable, but we do not guarantee uninterrupted or error-free operation. Captures depend on your camera phone, its power, and its internet connection, none of which we control. The Service may be affected by maintenance, outages, network failures, app store or operating system changes, or events beyond our control.

Snitchy is not a security system. It is a time lapse and monitoring tool. Do not rely on it to prevent or detect theft, damage, injury, or loss. We are not liable for anything the camera did or did not capture.

12. Hardware store

• Prices in the store are in Australian dollars. Shipping is charged at checkout as shown on the product page.
• Payment is processed by Stripe. A contract for sale is formed when we email you confirmation that your order has been dispatched. We may cancel and refund an order before dispatch if an item is out of stock or was mispriced.
• Delivery times are estimates. Risk in the goods passes to you on delivery to the address you gave us.
• International buyers are responsible for any import duties or taxes charged by their country.
• Shipping, returns, faulty goods, and change-of-mind returns are covered in our Shipping and Returns policy, which forms part of these Terms.
• The waterproof case and camera shade are accessories. Check that your phone fits before ordering and follow the fitting instructions. Water resistance depends on correct fitting and undamaged seals.

13. Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with a service you are entitled to cancel the service and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time and, if this is not done, to cancel the contract and obtain a refund for the unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified.

14. Disclaimers and limitation of liability

Subject to section 13 and to the extent permitted by law:

• The Service is provided "as is" and "as available", and we exclude all implied warranties and conditions.
• We are not liable for indirect, incidental, special, or consequential loss, or for loss of data, profit, revenue, or opportunity, arising from your use of the Service or from anything your camera did or did not capture.
• Our total liability to you for all claims arising from the Service in any 12-month period is limited to the amount you paid us in that period, or, where a guarantee under the Australian Consumer Law applies and permits it, to resupplying the service or goods or paying the cost of doing so.

15. Indemnity

You agree to indemnify Snitchy against claims, losses, and reasonable costs arising from your breach of these Terms or from your use of a camera in breach of any law or any third party's rights, except to the extent we caused the loss.

16. Suspension and termination

You may stop using the Service and delete your account at any time from the app's settings or by emailing us. We may suspend or terminate your account, with notice where practicable, if you breach these Terms, if your use harms other users or the Service, or if the law requires it. On termination your right to use the Service ends and we may delete your data in line with our Privacy Policy.

17. Changes to the Service or these Terms

We may change or discontinue features as Snitchy develops. We may update these Terms from time to time. Material changes will be announced in the app or on this website with an updated effective date. Continued use after a change means you accept the updated Terms.

18. Governing law

These Terms are governed by the laws of Australia and of the State or Territory in which Snitchy is based. You and we submit to the non-exclusive jurisdiction of the courts there. If you are a consumer outside Australia, you also keep any mandatory protections of the law where you live.

19. General

If any part of these Terms is found to be unenforceable, the rest continues in force. Our failure to enforce a right is not a waiver of it. These Terms, the Privacy Policy, and the Shipping and Returns policy are the whole agreement between you and us about the Service.
